Terms & Conditions

In the following terms & conditions, “the photographer” shall mean Art & Life By Dean, trading as Art & Life By Dean Photography. “The clients” shall be those persons defined as bride and/or groom on the form above. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed upon by the photographer in writing.

1. COPYRIGHT

i. The Copyright Designs and Patents Act assigns the copyright of the images to the photographer.

2. DISPLAY

i. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to promote the business in advertising, brochures, magazine articles, websites, sample albums, etc.

3. CREATIVE LICENSE, COVERAGE, AND REPRODUCTION

i. Photographs taken during the course of the event/shoot will be at the discretion of the photographer, although every effort will be made to comply with the clients’ requirements.
ii. Special requests are not binding instructions, although every effort is made to comply with the client's wishes. The photographer will do their best to honor requested photographs but cannot guarantee any specific picture, background, or group arrangements due to changes in weather or the availability/willingness of subjects.
iii. For bookings involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer can cover the ceremony may not be the photographer’s choice, and the photographer cannot accept responsibility for obstructed views.
iv. Due to varying lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs.
v. Although all equipment is checked regularly, and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs not produced due to technical failure.

4. RETOUCHING AND EDITING

i. The photographer will provide basic retouching and color correction on all photographs. Additional retouching beyond what is included may incur an additional fee. ii. Once the final edits are delivered, no further retouching or editing by the client or third-party editors is permitted.

5. PAYMENT

i. A non-refundable booking fee of $150.00 will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer's website. The booking fee will be deducted from the total cost of the chosen package when calculating the final balance.
ii. Payment in full of the remaining balance will be due two weeks before the shooting day.
iii. Additional goods ordered must be paid for in full at the time of ordering.
iv. Title to all goods remains with the photographer until paid for in full by the client(s).

6. TRAVEL AND ACCOMMODATION

i. Travel up to 45 minutes from the photographer’s base location is included in the package. Travel beyond this will incur additional costs, which will be calculated and agreed upon at the time of booking.
ii. For destination shoots or events requiring overnight stays, the client will be responsible for covering the photographer’s travel and accommodation expenses, which will be agreed upon prior to the shoot.

7. FORCE MAJEURE

i. In the very unlikely event of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.
ii. The photographer will make every effort to put the client(s) in touch with another photographer in the event they are unable to attend the shooting date due to any cause beyond their reasonable control (e.g., sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown, etc.).

8. DIGITAL NEGATIVE FILES

i. All digital negatives (computer files) remain the property of the photographer. All digital packages include a copy of the edited digital negatives for the client(s) for personal, non-commercial use.
ii. Should the digital negative files be lost, damaged, or destroyed for reasons beyond control, the photographer’s liability shall be limited to a full refund of any deposits and fees paid, excluding refunds for goods already received.

9. MODEL RELEASE

i. The client(s) hereby grant the photographer permission to use any photographs taken during the session for portfolio, marketing, and promotional purposes, unless otherwise specified in writing prior to the shoot.

10. CLIENT RESPONSIBILITIES

i. The client is responsible for ensuring the timely arrival of all parties involved in the shoot. Delays may affect the time and quality of the images captured.
ii. The client should communicate any special requests or requirements in advance to ensure the photographer can accommodate them.

11. CANCELLATION FEES

i. If the client(s) cancel a booking, the following fees will apply:
ii. Cancellation from the booking date and more than two weeks before the shoot will forfeit the booking fee of $150.
iii. Cancellation with less than two weeks to go until the shoot will result in full payment for the complete photographic package booked. The client(s) are advised to take out appropriate insurance to cover any expenses incurred in the event of cancellation.

12. DELIVERY

i. The photographer will endeavor to deliver digital negative files as quickly as possible. However, this can take up to 4 weeks during busy periods.

13. COMPLAINTS AND DISPUTE RESOLUTION

i. Any complaints regarding the services provided by the photographer should be made in writing within 14 days of receiving the final images.
ii. The photographer will make every effort to resolve any disputes amicably. Should a resolution not be reached, any legal disputes will be handled under the jurisdiction of [Local Jurisdiction].
